(INDIANAPOLIS) - An attorney for a Greensburg mother convicted in 1996 of setting a fire that killed her 3-year-old son expects her to be released on bond this week as she awaits a new trial on charges of murder and arson.
Kristine Bunch's attorney said Monday his client can't wait to breathe free air after 16 years in prison.
The state appeals court on Friday ordered a Decatur County court to either reinstate Bunch's original $5,000 bond or hold a new bond hearing by Wednesday afternoon.
The appeals court overturned the 38-year-old woman's conviction in March after her lawyers argued new science shows there was no evidence of arson in the 1995 mobile home fire.
Prosecutors said Bunch poured kerosene or some other fuel in the bedroom of her son, Anthony, and the living room of their mobile home and lit it on fire.
But lawyers working with Northwestern University School of Law's Center on Wrongful Convictions said science discovered since the 1990s shows that fuel couldn't have been used and that other possible causes were ignored.
The county prosecutor and state attorney general's office had no immediate comment.
