Carmel Man Charged With Raping 13-Year-Old

(CARMEL) - Prosecutors have just charged a man with raping a 13-year-old who drank and passed out at a late night party in Carmel.

19-year-old Charles Blake Bracken is charged with rape, child molesting, criminal deviate conduct, sexual battery and contributing to the delinquency of a minor.

The girl says she went to Carmelfest in early July and ended up at Carmel Woods Apartments on Range Line Road. Police say the girl was so intoxicated she started having seizures and was taken to St. Vincent Carmel Hospital.

According to the girl's mother, she dropped her daughter off at Carmelfest on the night of July 3rd. The girl called her mother around 10:30 pm saying that she'd found a ride home. When she hadn't turned up by 11:00 pm, the mother called her daughter's cell phone but it went to voicemail. A few hours later the mother got a call from the hospital telling her that her daughter was being treated for seizures and alcohol intoxication.

According to witnesses cited in the probable cause affidavit, a group of teens went to the apartment after Carmelfest. One witness said he saw Bracken giving the girl a cup of vodka mixed with Pepsi and encouraging the girl to drink alcohol throughout the party.

The girl was later seen vomiting in the bathroom. One witness said he smacked the girl and threw water in her face to prevent her from passing out.

Some of the people at the party later moved her to a bed in the bedroom. According to the probable cause affidavit, at least two witnesses reported seeing Bracken on the bed with the girl, naked to the waist at one point and wearing only boxer shorts in another witness account, and witnesses told police they thought Bracken was raping the girl. They also reported that the girl was naked when she started having seizures, and that they put her clothes back on before calling 911.

The Indiana State Police Lab says they found male DNA on the underwear that the girl was wearing that night. Further testing will be done to determine if the DNA is that of Bracken.

Bracken was taken to the Hamilton County where his bond was set at $50,000.
