Charges Against Mother Who Ate Rat Poison Will Not Be Dismissed

Last updated on Sunday, May 13, 2012

(INDIANAPOLIS) - Charges against mother accused of ingesting rat poison while pregnant will not be dismissed.

Bei Bei Shuai appealed to the Indiana Supreme Court to have the charges against her dropped. Friday, the court decided the murder and feticide charges will stand.

Shuai's attorneys said the baby's death was the result of a suicide attempt and not murder. They also said prosecuting a woman based on the outcome of her pregnancy is unconstitutional.

Prosecutors argue that Shuai wanted the baby to die, though. Something unusual came out of Friday. The decision allows Shuai to be released from jail on bond, something that's very rare in murder cases.
