Man Withdraws Insanity Defense In Son's Death

(SOUTH BEND) - A South Bend man accused of beating his 10-year-old son to death and of beating another son has withdrawn his insanity defense.

The move Wednesday comes three weeks after three doctors submitted their mental health evaluations of 35-year-old Terry Sturgis to the court and the judge ordered them sealed. Sturgis' attorney, Jeff Kimmell, tells the South Bend Tribune that the doctors explored whether Sturgis was suffering from dementia as a result of his ongoing dialysis treatment and determined that was not an issue. He says that is why the insanity defense was withdrawn.

Also Wednesday, Kimmell filed a motion to have two charges of neglect of a dependent dismissed. Judge Jane Woodward Miller will hear that motion on April 19.
