Death Penalty Sought In Killing Of Northern Indiana Woman

(ROCHESTER) - Fulton County Prosecutor Rick Brown is seeking the death penalty against one of three men accused of murdering an 81-year-old woman by shooting her in the back while robbing her home in November.

Brown says Bell should be sentenced to death because he intentionally killed Wilma Upsall during a burglary at her home 10 miles northwest of Rochester and because he criminally confined her.

Upsall was tied to a chair with a telephone cord during the burglary. Bell's attorney, Edward Ruiz, would not comment Thursday when asked by The Associated Press about the death penalty request.

Jason Miller of Plymouth and William Scroggs of Delong also are charged with murder.
