Prosecutor Faces Federal Lawsuit After Murder Conviction Overturned

(ANDERSON) - A central Indiana prosecutor is facing a federal lawsuit from a man whose murder conviction was overturned.

Walter Goudy has filed a suit seeking unspecified millions of dollars in damages against Madison County Prosecutor Rodney Cummings.

Goudy spent 15 years in prison for murder before a federal appeals court ordered his release.

His attorney, Richard Dvorak, alleges Cummings withheld evidence from the defense. Cummings told The Herald Bulletin that he shared everything with them but it wasn't properly noted.

Cummings said he also believes a jury hearing the lawsuit will support him.

Goudy was originally arrested by Cummings, who was a police officer at the time. The prosecutor at that time dismissed the case, but Cummings filed charges against Goudy when he became prosecutor.
