No Charges Against Woman Who Gave Birth In Toilet

(JEFFERSONVILLE)(WDRB) - Clark County prosecutor Jeremy Mull decided on Monday that he would not charge a woman who give birth to twins in a toilet, because she had no criminal intent to kill the child.

Betsy Dalton made a 911 call from the America's Best Inns and Suites in Clarksville in July, along with her boyfriend Jerry Conrad. Both are mentally challenged.

Dalton: "How would you get maybe one newborn baby out of the toilet?"

911 Operator: "What?"

Dalton: "I didn't know I was pregnant."

The baby boy died. The sister survived after being delivered in a motel room toilet. Police said the couple had been living there.

Prosecutor Jeremy Mull said an autopsy showed the baby drowned in the toilet. The prosecutor says the case is now closed. The boyfriend also will not face any charges.

No word on where the surviving baby is staying right now. At last word right after her birth, she was placed in the custody of Indiana Child Protective Services.
