(UNDATED) - Indiana Secretary of State Charlie White has filed a complaint of voter fraud against former Senator Evan Bayh and his wife Susan with the Marion County Prosecutor's Office.

White is alleging that the Bayhs voted in the Indiana's May primary by absentee ballot while living in Washington D.C..

White claims fraud because Bayh had stepped down from his position as senator and was no longer representing Indiana while living in Washington.

White also accuses Bayh of claiming a homestead property tax exemption for a condo the Bayhs own in Indianapolis. White says that's homestead fraud because the Bayhs do not primarily live in that residence.

White has requested that Marion County Prosecutor Terry Curry appoint two independent prosecutors to investigate his allegations and "take appropriate action."

White himself is currently facing seven charges, including voter fraud. His trial is scheduled to begin January 30.
