(INDIANAPOLIS, IN) - The Indiana Supreme Court ruled that residents do not have the right to block a police officer’s entry into their home.
The case stems from a 2007 Vanderburgh County incident where a man tried to block police from entering an apartment while he and his wife argued.
Police were responding to a 9-1-1 domestic disturbance call at the time.
The husband and wife were found arguing outside of the apartment and police followed when they moved back inside.
The husband told police they weren't needed but insisted on entering the apartment anyway. The court's decision was split 3-2.
The majority claimed police acted reasonably under the circumstances because it was un-realistic for them to wait until an actual act of violence occurred.
