Court Upholding Man's 50-Year Sentence

Last updated on Tuesday, December 22, 2009

(INDIANAPOLIS, IN) - The Indiana Court of Appeals is upholding the 50-year-prison sentence given to a Gary man who shot an east Chicago woman in the head in August 2008.

Gaylon Washington Jr. claimed the trial court did not consider his mental illness as a factor in his actions before imposing the sentence.

The appeals court ruled 3-0 Monday that the sentence would have been the same even if Washington's mental illness was considered separate from other mitigating factors.

Washington pleaded guilty to felony voluntary manslaughter in March.
