(CARMEL, IN) - A state legislator continues to recover after being severely beaten over the weekend.

66-year-old State Representative Ed Delaney was beaten and robbed by 38-year-old Augustus Mendenhall along a street in Carmel on Saturday.

Mendenhall led Delaney to Carmel, telling him it was for a business deal.

According to police documents, as the two talked, Mendenhall allegedly pulled a gun and attempted to shoot Delaney, but the gun jammed.

Mendenhall then beat Delaney until police arrived.

Mendenhall attempted to run away after also stealing Delaney's wallet, but was tased by police and taken into custody.

Delaney suffered several broken ribs, broken facial bones, a collapsed lung and needed staples in his head.

He will require surgery for some of the wounds.

He is listed in fair condition. Delaney's wife, Ann, released a statement: "he is in a lot of pain, but his spirits are good.

We are taking comfort in the prayers and expressions of our friends, family and well-wishers."

Mendenhall has told various media outlets that the incident stemmed from Delaney's involvement in shutting down Mendenhall's father's porn shop business in 1983.

The Mendenhall family went broke fighting the court battle for six years.

Delaney represented the owner of the land where the building was located.

Mendenhall is charged with attempted murder, armed robbery, aggravated battery and criminal confinement armed with a deadly weapon.

He is being held in the Hamilton County jail on a $3 million dollar bond.
