(INDIANAPOLIS, IN) - A much anticipated murder trial begins Monday in Marion County.

Seven family members, three of them children, were killed in their home in Indianapolis on June 1st, 2006.

Two years later, the house was gutted by fire.

That case is still an unsolved arson.

Prosecutor Carl Brizzi wanted the death penalty for accused triggerman Desmond Turner.

But he dropped that quest, bringing objections from victims' survivors in a deal that included Turner waiving his right to a jury trial.

It will be a bench trial instead, meaning Judge Robert Altice will render the verdict.

A co-defendant, James Stewart, will be tried later.

Brizzi faces possible State Supreme Court discipline over his comments in this case and one other.

Judge Robert Altice himself threatened Brizzi with a gag order.
