Battle For Mayor Of Terre Haute Goes To Supreme Court

(TERRE HAUTE) - A challenge to the 2007 election for mayor of Terre Haute now rests in the hands of the Indiana Supreme Court.

Edward Delaney, the attorney representing former mayor Kevin Burke, and Bryan Babb, stating the case for Mayor Duke Bennett, had 20 minutes each Thursday to outline their arguments before the five-member court.

Burke, a democrat, lost the 2007 mayor's race to republican Bennett by 110 votes out of about 12,000 cast.

Burke then challenged the election result, charging Bennett was ineligible to run under Indiana law.

Bennett and Burke both asked the state supreme court to take the case on appeal, which the high court last month announced it would do.

The Supreme Court is expected to take several months before rendering a decision.
