Judge To Rule On Geist Annexation

Last updated on Wednesday, November 26, 2008

(FISHERS) - Fishers is asking a judge to throw out the legal challenge to its annexation of Geist.

Hamilton Superior Judge Steven Nation heard two days of witnesses on whether Fishers has presented an adequate fiscal plan for providing services to Geist, and whether homeowners there would be hurt financially. He has up to three months to issue a ruling. But first, he'll decide whether to simply dismiss the case.

Attorneys for the town contend the evidence offered by annexation opponents doesn't address the legal issues. Attorney Doug Church argues this year's tax-reform law changes the financial landscape for homeowners so much that opponents need to prove they're still opposed in spite of it.

Nation says he'll rule on the dismissal motion Wednesday.
