(GEORGETOWN) - A former state trooper convicted of murdering his family asks the Indiana Supreme Court on Thursday to throw out his convictions — for a second time.
The Indiana Court of Appeals threw out David Camm's first conviction in the deaths of his wife and two children, saying testimony about Camm's extramarital affairs had prejudiced the jury.
Before Camm's second trial, a second defendant was arrested in the murders. Charles Boney was convicted in a separate trial.
Prosecutors argue Camm arranged the murder with Boney, although a judge threw out a conspiracy charge for lack of evidence. "Here you have a man who's indisputably at the scene of a crime, but he has no connection to the defendant. The logical inference would be that this man, Charles Boney, committed the crime alone," argues defense lawyer Stacy Uliana.
Uliana contends she should have been allowed to present evidence about Boney's character and criminal history, to bolster the argument that Boney had reason to act alone.
Uliana is also challenging the judge's decision to allow testimony that Camm's five-year-old daughter had been molested.
Attorney General Steve Carter's office is declining comment until after Thursday's hearing.
