Father To Sue Clark County After Mentally Ill Son Dies In Jail

Last updated on Saturday, March 1, 2008

(JEFFERSONVILLE) - The father of a mentally ill man who died in a holding cell says he intends to sue Clark County.

23-year-old Timothy O'Meara of New Albany was in the Clark County Jail in Jeffersonville last August 22nd when he was found not breathing and slumped over the toilet.

Attorneys for O'Meara's father say jail officers failed to properly monitor the prisoner while he was being held on a probation violation. O'Meara apparently died from choking on a 4-inch piece of burrito. The autopsy report noted the 6-inch toothbrush found in his stomach.

Clark County Attorney Dan Moore says he's was aware of an intent-to-sue notice but said he couldn't comment on the case.
