(STATEHOUSE) - Indiana Chief Justice Randall Shepard expects a quick ruling by the Indiana Supreme Court in a case challenging the validity of arrests by former IPD officers who weren’t sworn in to the new Indianapolis Metro Police Department.
Attorneys for a woman arrested on drunken- driving charges claim the arrest was invalid because the officer had not been sworn in to IMPD. A Marion County judge agreed and dismissed the charges. The state appealed to the high court.
Indiana Attorney General Steve Carter says there's nothing in state law that requires an oath. He says it's a ceremonial process that officers take when they join the police force and this officer had done that.
The court's decision could have a bearing on almost all arrests made by Indianapolis Metro Police since January 1.
