(TERRE HAUTE) - A judge today will hear a case on who should be the mayor of Terre Haute.

Attorneys for Kevin Burke and Duke Bennett will be addressing the issue of Bennett's eligibility under the Hatch Act.

Burke says Bennett is not eligible to be mayor because he works for The Hamilton Center, a not-for-profit organization that receives federal funding.

Bennett contends that he does not work directly with any programs that receive federal funding and therefore he is eligible.
