(STATEHOUSE) - Attorney General Steve Carter’s office is investigating the legality of phone calls made by GOP operatives bashing Democratic Congressional Candidate Tom Hayhurst.

Republican leaders claim the calls are legal because they're not automated and are made by a real person.

A number of Democrats, including the top Democrat in Elkhart County, filed a complaint with Carter over the 30 second phone ads, saying no questions could be asked of the caller and the recipient's presence was never acknowledged. Republican leaders say that's not necessary under state statutes.
