Anonymous Phone Calls Do Not Justify Pull Overs
STATEHOUSE—The Indiana Appeals Court says anonymous phone calls do not alone justify pulling over drunk drivers.
The ruling involves the case of Charles Powell who was stopped in Martinville in May of 2004 for alleged drunk driving. The officer did not witness Powell's alleged behavior, but testing and was charged with drunk driving and being an habitual traffic offender.
The Appeals Court says since the officer could not corrobrate reason to pull Powell over, all evidence obtained at the scene cannot be used during the trial.
