Attorneys Grilled Over Meyers Appeal
(INDIANAPOLIS) - The three judge Indiana Court of Appeals had some tough questions for the attorneys on both side of the argument for John Meyers to get a new trial.
Myers was convicted by a jury in 2006 for the murder of Jill Behrman, a 19 year-old IU student who disappeared in 2000 while riding a bicycle. Her remains were found three years later.
Myers' murder trial was based entirely on circumstantial evidence. His attorney focused on prosecution witnesses mentioning a polygraph test and an opinion about Behrman being sexually assaulted which was never proven.
Myer's attorney also told the court the sequestered jury in the murder trial failed to take their role seriously.
The judges questioned the state's attorney over the same issues, especially the mention of the polygraph test which the state admitted was a big mistake on their part.
The three judges on the Court of Appeals gave no timetable for a decision.
Myers is serving a 65-year prison sentence for the murder.
