Orange County Judge Takes Shot At Auto-Dialer Law

(UNDATED) - Indiana’s auto-dialer law is being challenged by an Orange County judge.

Orange Circuit Judge Larry Blanton ruled that the law does not apply to political messages. He claims that a political message, delivered during a political campaign, is not the selling of a tangible product.

Indiana Attorney General Steve Carter disagrees, saying that the auto dialer law was created to regulate the use of technology -- not commerce.

Once the judge issues his written ruling, Carter says he is ready to file an appeal. In the meantime, Carter says his office intends to enforce the law.

Carter had originally filed suits associated with auto-dial messages during the 2006 election. The ruling from Judge Blanton was specifically related to the Baron Hill and Mike Sodrel campaign for Congress.
