Lawyers Want To Drop Case Against Jail Employee

(BLOOMINGTON) - Lawyers representing a former Monroe County Jail employee want the case against him thrown out.

Attorneys for David Shaw say a court has exceeded its time limit to bring him to trial on counts of felony battery.

Shaw was charged after using a stun gun on Bedford resident James Borden, a disciplinary measure which eventually led to Borden's death.

Coroners ruled the taser aggravated an existing heart condition, causing Borden's demise.

Attorney Kitty Liell says the court had until April to bring her client to court, and since it failed to do so, he should be released.
