Lawyer Asking For Jailer's Release

(BLOOMINGTON) - An Owen Circuit Judge must decide if a battery case against a former Monroe County jailer should be dropped.

David Shaw was charged in connection with the taser death of Bedford resident James Borden in May of 2004.

Shaw's lawyer says the charges should be dropped because the case didn't go to trial within one year of its filing, which is a state law. She claims the time ran out in April of 2005 because Shaw was charged in May of 2004.

Special Prosecutor Barry Brown says the clock began ticking in September 2004 when Shaw was summoned to court. Judge Frank Nardi gave Shaw's lawyer an August 4 deadline to respond to Brown's legal brief.
