Suit Demands State To Block Ruling

Last updated on Thursday, May 18, 2006

(INDIANAPOLIS) - An Indianapolis voting-machine supplier is suing to block
Secretary of State Todd Rokita from ruling on whether the company should be fined for delays in getting its equipment certified.

The Secretary of State acts as an administrative law judge in hearing cases involving voting-machine standards.

Microvote Attorney John Price says Rokita has forfeited the unbiased approach a judge is required to have.

Rokita would still get to appoint his replacement if Marion Superior Judge Robyn Moberly disqualifies him from hearing the case himself.

Microvote could face thousands of dollars in fines for not getting its machines certified until four days before this month's primary.
