(DAVIESS CO.) - A Birdseye man was sentenced to 900 days in prison after negotiating a plea agreement on a count of sexual misconduct with a minor.
Daviess County Superior Court Judge Dean Sobecki sentenced 32-year-old Kyle Sickbert to 360 days in the Daviess County Jail or to home detention with the remaining 540 days of his sentence suspended. He was also ordered to complete moral reconation therapy and be evaluated for sexual abusers treatment and classes.
Sickbert was arrested July 24, 2015 after the Daviess County Police Department received information that Sickbert was allegedly involved in several sexual encounters with a 12-year-old girl in the Montgomery.
Police say Sickbert raped the girl during the early morning hours of July 5, 2015 while staying overnight at his girlfriend's family's home in Montgomery.
Sickbert was originally charged with two Level 1 felony counts of child molesting, two Level 4 felony counts of child molestation, one Level 6 felony count of sexual battery and one Level 6 felony of sexual misconduct with a minor. But in a negotiated plea deal those charges reduced to one count of sexual misconduct with a minor.
The Dubois County Free Press reported that during Monday's sentencing the girl's mother told Judge Sobecki she will never forget the day her daughter told her about the incident.
The mother shared she had to pull her daughter out of school after students learned what happened and teased her. Her daughter then began cutting herself due to posttraumatic stress disorder and sleeps with a baseball bat and knife under her bed.
In April of last year, her daughter attempted to take her life.
The victim's mother then told Judge Sobecki that the judicial system failed her daughter and her, saying it was an injustice that the charges were reduced.
Sickbert did not give a statement during the hearing and was remanded to probation immediately afterward.
