(BLOOMINGTON) - Indiana University has reached a settlement in a case involving a sexual assault at its Bloomington campus.
The former female student sued IU claiming the college fostered a dangerous environment by ignoring a history of sexual assault by student John Enochs.
Monroe County prosecutors initially charged John Enochs with two counts of felony rape in connection with those incidents, which they say happened in 2013 and 2015. Enochs denied the charges. As part of a plea deal, he pleaded guilty to a lesser charge of battery in exchange for two rape charges being dismissed.
The lawsuit also names Delta Tau Delta fraternity, which is where one of the alleged assaults took place. Court documents say the fraternity "acted recklessly, willfully and with wanton disregard to the safety of Jane Doe by permitting, sanctioning, and encouraging behavior that increased the risk of sexual assault."
Jim Ewbank, attorney for the national fraternity, says they're being improperly sued.
"The Supreme Court of Indiana has ruled consistently that under these circumstances, motions to dismiss the National Fraternity are valid, and we expect to file a Motion to Dismiss Delta Tau Delta Fraternity in this case within the near future," he added.
IU has not commented on the settlement.
