(BROWN CO.) - A Nashville man accused of rape will not go to trial until March 27.
While he is waiting to face a jury of his peers, the state is attempting to use prior criminal acts committed by 39-year-old Rickey Haines as evidence against him. All the acts were committed against the same woman.
According to court records, Haines was arrested on December 11, 2015, two days after the woman contacted police claiming Haines had raped her at his home in the 5690 block of Three Notch Road.
Haines is facing felony charges of rape, criminal confinement, domestic battery and strangulation. He is currently being held in the Brown County Jail on a $100,000 bond.
According to court documents, Haines is also facing assault charges from a June 2015 incident involving the same woman. In that case he is facing three counts of domestic battery, criminal recklessness, criminal mischief, invasion of privacy and unlawful possession of a firearm by a domestic offender.
He was arrested on those charges and released from jail after posting bond June 18. Conditions of his bail included having no contact with the victim and not possessing any firearms.
But less than six months after his release, Haines was charged with rape, criminal confinement, domestic battery and strangulation after the same woman reported that he attacked her repeatedly at his home Dec. 8 in the presence of two children.
He will face charges in both cases during his jury trial.
Prosecutor James Roberts wrote in court documents that Haines has prior domestic battery convictions against the same victim.
He cited 11 court cases where previous violence, intimidation and threats between the accused and victim were used in court as evidence against Haines in the past. He has requested the court to allow him to use that evidence at this trail.
Judge Judith Stewart will hear arguments on whether or not to use the prior acts of violence at a Feb. 3 hearing.
The alleged rape:
According a probable cause affidavit, on December 8, 2015 Haines attempted to force the woman's head into a bathtub full of water and sexually assaulted her in the bathroom.
She told Brown County Police that Haines was upset that she was talking to another man.
Haines followed the victim outside, yelling at her to unlock her phone, she told police. Haines then threw a bicycle at her and ripped a pole from the railing of the porch and hit her repeatedly with it, according to a probable cause affidavit.
The children told police they heard banging on the house and saw Haines put the woman in a choke hold.
Back inside, Haines allegedly loaded a gun and threatened her with it.
The woman told police Haines sexually assaulted her that night and prevented her from leaving. She told police he used her cellphone to record the assaults and threatened to post the videos on social media for the man she was talking to to see, according to the affidavit.
The next morning, Haines deleted the videos before giving the phone back to her and went to work.
