(BLOOMINGTON) - A former Monroe Water Treatment Plant employee will not face criminal charges following the disappearance and possible sale of 166 chemical storage containers.
Plant Service Mechanic Barry Milbourn was fired in September after he admitted taking the empty storage containers for personal use or to sell. Plant Superintendent Tim Gholson also resigned his position.
The 268-gallon plastic containers with a metal cage-style framework were periodically delivered to the plant containing polymer used in the water treatment process. The containers were included in the purchase of the chemical from supplier Brenntag AG. The estimated value of the missing containers is between $8,300 and $12,500 on the salvage market.
The Herald Times reports, a thorough investigation by the Bloomington Police Department did not reveal a 'criminal intent' on the part of Milbourn, says Monroe County Chief Deputy Prosecutor Bob Miller, which is an essential element of a theft charge.
Police say it is possible that Milbourn may have been given the impression that he could remove the property for his personal use.
