(FAYETTEVILLE) - A Springville man was arrested Friday afternoon after an Indiana State Police trooper was called about a domestic fight at a home in Fayetteville.
Arrested was 47-year-old William Martin, of Springville, on warrants for petition to revoke and failure to appear and new charges of residential entry, trespassing, battery on a child under the age of 14 and disorderly conduct
According to Indiana State Trooper Robert A. Whyte, when he arrived on the scene he spoke to two females who said Martin had left the scene.
The owner of the home told police, her father had come over to her house intoxicated
"Herself, 2 additional adults and a 7-month-old child were asleep in the residence when William Martin arrived," Trooper Whyte says. "Mr. Martin could not enter the front door because it was locked. He walked to the back door of the residence and pried the door open with a flathead screwdriver. The occupants of the residence woke at the noise of the door being pried open."
Martin was confronted by his daughter and her boyfriend and asked to leave multiple times. He refused saying he didn't have to. There was a verbal argument and that is when Martin allegedly walked over to the baby he is not related to and attempted to pick him up. Martin didn't realize the child was buckled into a car seat.
"He did not unbuckle the child," Trooper Whyte says. "As Mr. Martin picked the child up the straps of the car seat applied pressure to the child's neck and chest. Mr. Martin picked the baby up and left the car seat hanging below the child."
The 7-month old child was crying as he was held by an intoxicated Martin. The child's mother ran over and grabbed her child.
Martin was told the police had been called and fled the home.
When the trooper arrived there were still red marks on the child's neck.
After conducting his interviews, Trooper Whyte requested the assistance of two Lawrence County officers. Officer met Martin at his home in Springville.
"At the time of the arrest Mr. Martin was 3.5 times the legal limit to drive a vehicle in the State of Indiana," Trooper Whyte says. " It was found out after the arrest that Mr. Martin was also wanted out of Lawrence County on two felony warrants."
Martin was transported to IU Health Hospital to be medically cleared by a doctor and then taken to jail.
