Pre-School Owner Enters Pretrial Diversion Program

(BEDFORD) - A Mitchell pre-school owner settled her case Tuesday afternoon when she agreed to enter into a pretrial diversion program.

51-year-old April Shaw accepted the prosecutor's offer, even though she says she did not batter the child in her care.

According to in Lawrence Superior Court I documents, Shaw must not commit any offense for one year, pay court fees totaling $383 and must notify the director of the pretrial diversion program at the prosecutor's office if she moves, if she is arrested or if she is charged with any criminal offenses outside of traffic violations.

If Shaw doesn't meet those terms she will lose any money she's put toward the court costs and will be prosecuted on a Class D felony charge of battery on a person younger than 14.

Shaw was jailed on October 3, though the incident allegedly happened in 2013.

The parents of a then 2-year-old told police the toddler was battered while attending Lollipops and Rainbows Preschool, owned by Shaw and located on Dixie Highway between Bedford and Mitchell.

Shaw was accused of hitting the boy in the face, giving him a bloody nose after he "had an accident in his pants."

Shaw posted a bond of $755 cash the day she was arrested. The court ordered that money be used to pay her current court fees.
