(MARTINSVILLE) - A man was struck and killed by a semi-truck early Sunday morning on Ind. 37 near the Ind. 252 intersection.

According to the Martinsville Police, 33-year-old Joshua Mosley was dead when they arrived on the scene.

Police were able to identify Mosely by what appeared to be a hospital bracelet and a card in his wallet.

Police also recognized Mosley from an earlier incident at IU Health Morgan medical facility when an Indiana State Police officer brought him in for an investigation of possibly operating a vehicle while intoxicated. It was later confirmed that Mosley was released from the hospital at 4:41 a.m.

Police say Mosley was crossing the road at a non-intersection portion of the highway when he was struck by a semi driven by 44-year-old Jason Burdine of Whiteland.

Burdine told police he was traveling north on Ind. 37 when he saw a sport utility vehicle in front of him swerve to avoid something in the middle lane of traffic. Burdine was unable to avoid the object, then realized it was a person.

The driver of the SUV told police she swerved to avoid hitting Mosley, but believed there was nothing Burdine could have done to avoid hitting the man.

Burdine was given a blood-alcohol and drug test at the hospital. Those results are pending.

The accident caused the northbound lanes of Ind. 37 to be closed for more than two hours.
