(BLOOMINGTON) - A Bloomington man was arrested after a 4-year-old boy who was in his care suffered head injuries and was flown by helicopter to an Indianapolis hospital.

Bloomington Police say 25-year-old Cody Wasley is facing a felony charge of battery of a minor younger than 14 after police say he abused the boy while watching him.

Wasley told police the child slipped and fell on the wet kitchen floor, hitting his head. He denied ever hitting the boy. Wasley told police he heard the boy fall and the child then experienced difficulty breathing and started to vomit.

But Bloomington Police Capt. Steve Kellams say's the boy showed signs of abuse.

"He had fresh bruising on his face, shoulder, rib cage and back," Kellams says. "There was also an outline of a hand print on the boy's leg."

Officers were called to an apartment in the 700 block of West Gourley Pike at just before 7 p.m. Sunday after a report of a child unconscious and unresponsive.

A relative of Wasley's told police she had been doing laundry and returned to the apartment to find the boy unconscious in bed. She brought the child downstairs, placed him on the living room floor and called 911.

The child's mother told police she had given her son a bath before leaving for work around 3:30 p.m. Sunday and the child had no injuries at that time.

The child was taken by ambulance to IU Health Bloomington Hospital and was then flown to Riley Hospital for Children in Indianapolis for surgery.

This is not the first time Wasley has been in trouble with the law. According to court records in March he saw arrested for burglary in connection with an October 2012 home invasion robbery. In that case, a group of men reportedly forced their way into a residence and took cellphones, cash and marijuana.

As part of that plea agreement, three charges of robbery were dismissed. So were the September 2015 charges of unlawful possession of a firearm and criminal recklessness with a deadly weapon and a December 2014 charge of battery with a deadly weapon.
