(LINTON) - A Linton man who was shot last month was arrested on a battery charge.
The Greene County Daily World reports, Greene County Police arrested 28-year-old Alejandro (Alex) Garcia on a Class A misdemeanor charge of battery resulting in bodily injury. He is scheduled to appear in Greene Superior Court May 9 at 1 p.m. for an initial hearing.
On March 15, Garcia was reportedly shot by 52-year-old Russell Hardisty of Linton and court documents say the shooting may have been provoked.
Greene County Prosecutor Jarrod Holstclaw says Hardisty will not be facing charges in this incident.
Greene County Sheriff's Department Det. Sgt. James O'Malley says after 9 p.m. on March 15, police received a call from Hardisty, reporting he had been struck in the head by an unknown assailant, and he had discharged his handgun.
Around the same time, Linton Police received a call reporting a man was yelling for help and had been shot.
Police say Garcia had suffered a non-life threatening gunshot wound to his lower extremities.
Witnesses told police on the night of the shooting, they had went bowling with Garcia and his girlfriend, when the two began arguing so they left early.
Witnesses say Garcia had been drinking beer during the outing.
A witness told police he heard someone had placed animal parts on the doorstep of Garcia and his girlfriend's home, which upset Garcia. Garcia who was pretty drunk then went to talk to Hardisty, who he believed put the animal parts on his doorstep.
Garcia walked to Hardisty's house, where he was followed by a friend in a silver car, who attempted to get Garcia to leave.
Garcia told police Hardisty exited the garage where he was sitting and fired two shots at him. That is when Garcia says he struck Hardisty in the head with a stick he had picked up along the way.
Hardisty told police he was sitting in the garage when he noticed a silver car drive past his driveway multiple times, so he grabbed his handgun before exiting the garage.
Hardisty says when he walked out the door he was struck in the head, so he fired his gun twice. After the subject fled, Hardisty told police he fired two more shots. He didn't know if he struck the individual.
He then called 911 to report the incident.
While Hardisty was not charged in this incident, he is facing charges in a separate incident in which he allegedly threatened Garcia's brother with a knife. In addition, two petitions to revoke suspended sentences were filed as Hardisty was on probation for earlier charges.
The Greene County Sheriff's Department was assisted by the Linton Police Department, Indiana State Police and Indiana Conservation.
