Mitchell Man's Sentencing Continued

(BEDFORD) - A Mitchell man appeared in Lawrence County Superior Court I for his sentencing, but the judge decided to continue the sentencing so his family can find a 90-day rehabilitation program

31-year-old Justin Tolbert pleaded guilty to dealing meth and heroin on January 15.

During his sentencing Tuesday, defense attorney Scott Callahan and Tolbert's family asked Judge Michael Robbins to place Tolbert on house arrest.

Judge Robbins would not guarantee that he would impose that sentence, but he did give the family time to find a rehabilitation program.

Judge Robbins ordered Tolbert to have a mental health evaluation at Centerstone.

Tolbert will remain in jail until his next hearing on February 23 at 2:30 p.m. when Judge Robbins will sentence him.

Tolbert was arrested after a six month investigation by the Lawrence County Drug Task Force using a confidential informant to purchase drugs from Tolbert.

On November 18, 2014, Drug Task Force officers and the Lawrence County Emergency Response Team served a search warrant on Tolbert's home in the 4500 block of Port Williams Road.

When police entered the home they found a gram of heroin and a gram of meth on a table in the living room. They also found additional drugs packaged to sale, drug paraphernalia and a small amount of marijuana and a handgun.

In total, officers recovered more than 24 grams of meth heroin and 4 of heroin in the home.

Tolbert was not home during the search. But police did arrest Brandon Eagan of Mitchell, who was staying with Tolbert. Eagan was charged with possession of meth and heroin and maintaining a common nuisance.

An arrest warrant was issued for Tolbert. His father, Randy Tolbert, turned in his son on December 4, 2014.
