(GIBSON CO.) - James Allen of Washington, the driver of the van involved in the I-69 accident on September 24 killing two, appeared in court after being arrested.
Bruce Vanoven with the Gibson county sheriff's department says local law enforcement hope justice can be brought to those affected by the accident. Jacque Estime says a spokesman in the Washington Haitian community says justice can never be attained because it will not bring back 29-year-old Christela Georges and 60-year-old Gena Moise. Both women died from injuries sustained in the incident
Allen is facing 22 charges including driving while under the influence of marijuana resulting in the death.
In court, 30-year-old Allen was appointed a public attorney. The prosecution expressed concerns that the Hatian community might not have the means to commute to Gibson county for court proceedings. They say they will need a translator to help communicate with members of the Hatian community who will be interviewed. Allen's next status hearing is December 3rd.
A civil suit has been filed on behalf of two victims by Richard Hawley of Robert John and Associates, an Evansville-based firm, who filed the suit in Gibson County Superior Court in October.
According to a release from the attorney's office, Charles Joseph and Abigail Cura were seriously injured in the crash saying tens of thousands of dollars in medical bills would cause a huge financial burden as well as burdens for the other 25 victims, including the infant born to Christela Georges, one of the two women killed in the crash.
The suit alleges that defendants were negligent due to unsafe speed, unsafe lane movement, overweight load, driving on defective tires, improper safety equipment, and improper maintenance of the van. It is also alleges that the owner negligently entrusted the van to the driver.
