Mitchell Mayoral Candidate Dan Terrell Files Petition For Recount Of Votes

(MITCHELL) - Mitchell Mayoral Candidate Dan Terrell has officially filed a petition for recount today in the Lawrence County Clerk’s Office.

Clerk Myron Rainey says the petition was filed because Terrell believes residents who did not live within the city limits cast their vote for mayor.

In the November 3th election Independent John "JD" England edged out Republican candidate Dan Terrell by four votes 499 to 495 to claim the Mayor's seat. Democrat Eugene "Pud" Terrell received 229 with Bill Conley receiving 8.

According to the petition, Terrell claims A). a mistake was made in the printing or distributing of ballot; B.) a mistake in the programming of an electronic voting system occurred; C) an electronic voting system malfunctioned and /or D.) a deliberate act or series of actions occurred in one or more of the following precincts: Marion 1, Marion 2, Marion 3 and/or Marion 4 making it impossible to determine the candidate who receive the highest number of votes cast in the election.

Because of the above, Terrell believes he is entitled to a hand recount of the votes.

Terrell is requesting the court to enter an order appointing a recount commission, set a date, time and place for the recount and further order impound of the election materials and proceedings be had pursuant to Indiana Code 3-12-6-1.
