(MITCHELL) - A Mitchell man was arrested for the second time in a week.
On Monday night police arrested 41-year-old Kevin Blackburn on charges of residential entry, criminal recklessness and intimidation.
According to Lawrence County Sheriff Mike Branham, on Monday police received a 911 call from a resident at 843 Earl Road Mitchell.
The caller told police Blackburn was on his property and chasing him with a hammer.
Officers from the sheriff's department and Mitchell Police Department responded to the scene and arrested Blackburn.
The victim told police that he was outside at his truck retrieving a .22 rifle from where he had been squirrel hunting when Blackburn came out of the wood line and came at him with a hammer in his hand.
The victim says he told Blackburn to leave, but he continued to the man and swung the hammer, claw side first, at the victim's face, just missing him.
The victim ran inside the house.
Blackburn then attempted to gain entry through the front and back door, damaging both doors.
Blackburn's ex-wife and child were inside the home. Blackburn told police he was attempting to get his son, alleging his son had been kidnapped.
"There is no evidence to indicate that the child was kidnapped as he was safe with his mother," Sheriff Branham wrote in an email. "Department of Child Service was contacted regarding the incident."
This was the second time Blackburn had been arrested this week on Sunday Blackburn was arrested after he allegedly pushed an 83-year-old man down on the concrete, injuring him.
According to Sheriff Mike Branham, at 5:23 p.m. Sunday officers were called to a home at 1489 Wesley Chapel Road after a report of a fight. When officers arrived they found an 83-year-old man had suffered injuries to his head and elbow. The man refused medical treatment.
While officers were talking to the victim Blackburn returned to the home.
Blackburn told police he pushed the man because no one was helping to bail his brother out of jail. He is facing a charge of battery causing bodily injury.
