Police Arrest Washington Woman On OWI Charges

(PETERSBURG) - Petersburg Police arrested a Washington woman Thursday night after spotting her driving a vehicle on State Road 57 and swerving back and forth between lanes.

Heaven Berry is facing a preliminary charge of operating a vehicle while impaired with a controlled substance.

Berry told police she was having mechanical problems with her car.

Berry of Washington received a five-year sentence for her part in the shooting death of 17-year-old Devan Burris back in December 2014.

Berry was ordered to spend two-years behind bars and three years on probation for assisting a criminal.

Authorities say Berry invited 18-year-old Logan Evans, also of Washington, to stay at her home the night police were searching for him in connection with Burris' murder.

Evans later pleaded guilty to the murder and was sentenced to 45-years in prison.

17-year-old Burris was shot on December 6, 2013. Evans has maintained he did not mean to shoot Burris.

19-year-old Lucas Benjamin of Washington was sentenced to 30 years in prison in connection with the shooting death of Burris.

Benjamin pleaded guilty to charges of assisting a criminal and attempted dealing in meth as part of a negotiated plea agreement.

Charges of conspiracy to commit murder were dismissed.

Benjamin was with Evans near the Ebenezer Baptist Church on Oak Grove Road to do a drug deal when that deal went wrong.

According to police, the two men went to the church to sell Burris $100 worth of meth.

During the drug deal, Benjamin alleges Burris and another man grabbed him by the hood of his jacket and tried to pull him out the car. Benjamin says the man had a gun pointed at his face and began hitting him.

He told police as he was being pulled from the car, he heard a gunshot and then everyone began screaming.

Benjamin told police Evans did not intend to shoot anyone, but was trying to scare them.

Burris was then taken to the emergency room at Daviess Community Hospital and dumped out of the vehicle where he died.
