Owen County Man Arrested On Child Molesting Charges

(BLOOMFIELD) - An Owen County man was arrested late Monday night after a warrant was issued for his arrest on a preliminary charge of child molesting, a Level 1 Felony.

Under Indiana's current crime classification system, a Level 1 Felony is the most serious class of crimes.

The Greene County Daily World reports that 45-year-old Genaro Gene Garcia of Spencer was booked in to the Greene County Jail around 10:30 p.m. Monday by Greene County Sheriff's Deputy Bobby Pierce.

Garcia has been under investigation since the Greene County Sheriff's Department was contacted on June 20th about the incident.

According to a probable cause affidavit, Greene County police were called to a home about Garcia being intoxicated and refusing to leave the home. He refused to take to police and taken to the sheriff's department. Once there he refused to cooperate and requested an attorney. He was eventually transported to his residence in the Spencer area.

Det.Jim O'Malley has continued to investigate allegations that Garcia allegedly molested a young child in a wooded area outside of the Greene County home. The child was taken to St. Vincent Children's Hospital in Indianapolis for a physical examination that was concluded late on the same night as the reported incident. A State of Indiana Sexual Assault Evidence Collection Kit was completed, photographs were taken and the child's clothing was collected as evidence.

In a probable cause affidavit prepared by O'Malley, he indicates that information obtained during interviews, obtained in some video surveillance footage, and some DNA evidence, supports the child's story of what happened.

However, the laboratory results returned so far have not confirmed a positive match with the DNA profile of Garcia, but additional testing is currently underway with results pending.

All pertinent evidence was transported to the Indiana State Police Laboratory in Evansville by July 2 and some initial results were returned to the sheriff's department on July 27.

Following receipt of those results, a case was filed against Garcia in Greene Superior Court and on Monday, a warrant was issued for his arrest.

Garcia was taken into custody within hours and is being held on a $40,000 surety bond with ten percent allowed meaning he could be released by posting $4,000 cash.

He was scheduled to appear in Greene Superior Court for an initial hearing today.
