Opponents Of Brown County Fire Protection District To Present Petitions To Commissioners

(NASHVILLE) - Opponents of the Brown County Fire Protection District plan to present the Brown County Commissioners with a petition at their June 17 meeting.

Ron Sanders declined to estimate how many signatures against the fire district the group has to date. He said they will be gathering up to the day they present it.

In May 2013 the Indiana Court of Appeals reversed the Brown County Commissioners January 2009 decision to dissolve the Brown County Fire District.

The Fire District was essentially a loose affiliation with other fire departments that share resources, training and other items in an effort to better serve the residents and businesses in the area.

The court says the commissioners do not have the authority to make such a decision by ordinance alone.

The ruling did lays out the steps legally required to dissolve a fire district, which includes landowners petitions and public hearings.

Brown County resident and Attorney Bill Lloyd who filed the initial suit against the commissioners says the ruling provides future guidance for those communities who find themselves in situations similar to those in Brown County.

The county's fire district has been the subject of court hearings in the past.
