ISP Trooper Arrested After Operating Boat While Intoxicated

(BLOOMINGTON) - An Indiana State Police trooper was arrested on a charge of operating a boat while intoxicated at Allens Creek on Lake Monroe on Saturday night.

43-year-old Justin S. Butler of Bedford was arrested and taken to the Monroe County Jail on a charge of operating a watercraft while intoxicated with a blood alcohol content was 0.10 percent.

Indiana State Police said conservation officers from the Department of Natural Resources arrested Butler on a charge of operating a watercraft while intoxicated. He tested for a blood alcohol content of 0.144, nearly twice the legal limit in Indiana.

According to Department of Natural Resource Lt. Bill Browne, Butler's 1957 houseboat was stopped by officers for an idle-zone violation just after 8 p.m. Saturday.

Butler refused to take a breath-alcohol test at the scene. Officers obtained a warrant to for a blood test.

According to ISP Capt. Dave Bursten, Butler, who has been a trooper for nine years, has been placed on administrative desk duty at the Bloomington Post.

According to Bursten this is the second time Butler has been in trouble. He was previously suspended after he was driving an ISP Ford Crown Victoria with a measurable amount of alcohol in his system in September of 2007.

He was again under investigation after striking a pedestrian with his police car on a rainy Saturday night in January. According to a police report, Butler was off-duty and driving northbound on Rockport Road when he struck a 51-year-old Bloomington man, who was walking in the northbound lane. The pedestrian was wearing dark clothing, and the area was not lit by street lights. Butler rendered aid to the injured pedestrian. Butler was given a portable breath test at the time of the crash and the test confirmed alcohol was not a factor in the accident.
