(BLOOMINGTON) - The Monroe County Prosecutor's office says no charges will be filed against the part-time indiana University police officer who was accused of sexually assaulting a 19-year-old student in her dorm room during Little 500 weekend.

The 25-year-old was suspended without pay during the rape investigation and then resigned from the police force last week. But the case remains under investigation by IU's Office of Student Ethics.

According to Bloomington Police Capt. Joseph Quarters, the incident allegedly happened in the 1800 block of East 10th Street at a campus residence hall during the early morning hours of April 24.

The 19-year-old woman told investigators the two were acquaintances from the same residence hall, but he came to her room without being invited while she was visiting with another woman. Police say both women had been drinking.

Quarters says at some point after 2 a.m. the officer and the woman ended up in the woman's bed.

Later that day, just before 2 p.m., the woman went to IU Health Hospital and reported being raped.

University police were called to the hospital, but when they learned that one of their officers was accused of the rape, they contacted Bloomington Police Department to investigate.

Police say, the officer was off-duty and in civilian clothes at the time of the alleged assault. Both told investigators they were intoxicated, and gave different accounts of the night.
