(BLOOMINGTON) - Hud and Speck Mellencamp, the sons of musician John Mellencamp and model Elaine Irwin, plead guilty to misdemeanor charges of battery.
The felony battery charges against the brothers were reduced to misdemeanors during a court hearing Friday, because medical records did not substantiate "serious bodily injury" as charged in the felony battery case.
The two were arrested after being involved in a fight on July 23, 2013 at a party on Lincoln Street.
19-year-old Speck Mellencamp had gotten into a fight earlier in the night, and he returned to the party with his older brother and a friend for retaliation. He punched 19-year-old Alexander Bucy in the face on the porch of Bucy's Bloomington home because he thought Bucy had hit him earlier that evening.
It turns out that Bucy had nothing to do with the initial altercation.
Restitution has been paid to the man they injured, plus pain and suffering, in an undisclosed settlement between the families.
In a letter to the court, the victim asked that the Mellencamps be treated like anyone else in a similar circumstance facing a first-time misdemeanor.
Monroe Circuit Judge Marc Kellams said at the time of sentencing, the beating was violent; the teenager the Mellencamps beat up was punched in the face, then kicked while on the ground. He added that Speck Mellencamp was the primary perpetrator who "needs to assume the primary responsibility."
Speck was was sentenced to a one year in jail with all but four days suspended. He will be on probation of a year.
20-year-old Hud was also sentenced to one year in jail, with all time suspended and was ordered to complete 50 hours of community service in lieu of time in jail.
An illegal consumption of alcohol charge against him was dismissed as part of the plea agreement reducing the battery charges.
The case against a third man charged in the case, Tyler Smith, is still pending in court.
