(MITCHELL) - More details have been released in a probable cause affidavit of four Lehigh Cement Co. workers who were arrested Thursday on allegations they stole gasoline from the company.
Police arrested 36-year-old Bryan Tolliver and 48-year-old Charles Livingston, both of Mitchell, on felony theft charges. The two, who are mechanics for Lehigh, told police they stole the fuel while working and had been stealing gas for years.
According to the probable cause affidavit, Tolliver told police he was stealing between 15 to 30 gallons a week for six months, totaling between $3,000 to $4,000 worth of fuel.
Livingston allegedly told police he stole gasoline or diesel fuel twice a week for about two years, totaling between 200 to 300 gallons.
Advanced Investigation Solutions Inc., a private security company hired by Lehigh to investigate the alleged thefts, discovered Tolliver and Livingston pumped gas from Lehigh tanks into gas cans and then hid those in trash bags until they went home. On February 9, AIS placed a dye in the fuel and then on February 13 obtained a search warrant for the two men's home.
At Tolliver's home they found three 5-gallon gas cans containing the fuel and a large tank that Tolliver allegedly dumped more tainted fuel into. Tolliver told Indiana State Police he had been stealing the gas for about six months. He also told police Livingston was stealing fuel.
Livingston admitted he poured gas from the gas cans into a drum that he had at his home. He admitted to sealing both gas and diesel fuel. He admitted to stealing about 20 gallons on February 12.
Livingston then told police that Henderson was also stealing gas.
Police charged 42-year-old Justin Henderson of Orleans and 56-year-old Daniel Brooks of Mitchell on misdemeanor charges of theft.
At Henderson's home police found three gas cans in his vehicle and four gas cans at his home that contained the dyed fuel.
Henderson told police that he witnessed both Livingston and Tolliver steal gas in addition to Brooks.
Brooks admitted to stealing gasoline and police found 11 full cans at his home. He also admitted to giving some of the stolen fuel to Henderson.
All four were arrested on Thursday. Livingston and Tolliver both posted a $755 bond and Henderson and Brooks posted $505 bond and were released Thursday night.
