(UNDATED) - A ruling by the Indiana Court of Appeals is now headed to the Supreme Court.
Former Mitchell Police officer Randy Phelix filed a civil suit against the City of Mitchell to have his medical expenses paid after he was allegedly injured on the job.
Phelix, who was the Mitchell Police Department's drug officer, was employed with the department from November 1997 until March 2008. In March, Phelix decided that he could no longer perform those duties due to health conditions that Phelix claims were caused by performing his duties as a police officer. A year later he filed for disability and asked the city to pay for his medical expenses.
In October 2012 the city's civil insurance lawyer, Liberty L. Roberts of Roberts Legal Group LLC, asked a judge to determine if the city was responsible to pay those medical bills.
In February 2014, a special judge ruled in favor of Phelix stating the city must pay Phelix's medical bills. That prompted the city for file an appeal.
Seven months later, the appeal was granted in favor of the city, reversing the decision.
Now the case is headed to the Indiana Supreme Court. The court will review the case and will determine if the city's is responsible to pay those medical expenses.
