(PAOLI) - Orange County and Indiana State Police are investigating a shooting near the intersection of State Road 37 and County Farm Road near Paoli that has left one man dead and another injured.

Police say 48-year-old Michael Dale Kilpatrick of North Carolina and 30-year-old Keith Wagner of Bedford began arguing in the parking lot of Classic Muscle Cars and Parts.

A fight between the two employees began in the driveway and escalated with the men wrestling on the ground.

According to ISP Sgt. Philip Hensley, Wagner was able to escape and ran into a garage, locking himself inside. Kipatrick then began banging on the window.

"Mr. Wagner thought he was going to break the window, so he let him inside," Hensley says. "Once inside Mr. Kilpatrick shot Mr. Wagner in the stomach and neck at point-blank range with a semi-automatic handgun."

Kilpatrick then turned the gun on a witness and fired additional shots, but missed.

Hensley says the shots went through Wagner and he was able to tell investigators what happened.

Kilpatrick then ran into the woods behind the shop as Orange County officers and ISP troopers officers arrived on the scene. The officers began looking for Kilpatrick when they heard more shots fired. Police found Kilpatrick in a tree line behind the business where Kilpatrick had turned the gun on himself.

Kilpatrick was taken by ambulance to IU Health Paoli Hospital where he died from the self-inflicted wound.

Wagner was airlifted to the University of Louisville Hospital and is currently being treated for his injuries.

Hensley says the Kilpatrick was a temporary worker.

"I believe it came down to just a difference in opinion," he added. "I believe Mr. Kilpatrick had only been here for two weeks and wasn't going to be working here beyond the weekend and conflict just kind of stemmed from that."
