Jury To Begin Hearing Testimony In The Trial Of Kyle Hutton

Last updated on Wednesday, January 21, 2015

(BEDFORD) - A Lawrence County Superior Court jury of seven men and four females will begin hearing testimony this morning in the trial of 32-year-old Kyle Hutton.

Jury selection took all day and into the evening on Tuesday, as more than 45 potential jurors were questioned. Three alternates were also selected. The trial is expected to continue for two weeks.

Hutton is accused of being intoxicated the night he wrecked his CJ7 Jeep, causing the death of his wife and another couple in July 2012.

According to a probable cause affidavit, Hutton's blood alcohol content at the time of the wreck was 0.27 percent, which is more than three times the legal limit.

Lawrence County Prosecutor Michelle Woodward filed charges against Hutton, of Bedford, in May of 2013. He is facing three counts of causing death while operating a vehicle with a blood alcohol level of .15 or greater.

Hutton is being represented by Bloomington Attorney Samuel Shapiro. The state's case will be presented by Prosecutor Michelle Woodward and Deputy Prosecutor Jody Donaldson.

The accident happened on Bailey Scales Road, about 100 yards north of the intersection of Riley Boulevard.

When Bedford police officers arrived at the scene at 11:10 p.m., they found the bodies of 33-year-old Dasan Spires; Spire's fiancee, 38-year-old Laura Duncan and Kyle's wife, 30-year-old Morgan Hutton. All three had been thrown from the Jeep on impact and killed.

Police say Hutton was traveling south on Bailey Scales Road and hit a utility pole on the east side of the road, causing the vehicle to flip. Kyle Hutton was also thrown from the Jeep. Police say neither Hutton nor the three other occupants were wearing seat belts.

The police report lists Dasan Spires of Heltonville as being in the front passenger seat and says the two women were riding in the back seat.

Police found Spires near the overturned Jeep. Laura Duncan was found lying off the east side of Bailey Scales Road and the body of Morgan Hutton was found in a wooded area a distance away from the crash scene.

Kyle Hutton left the scene and called 911 from his home at 220 Riley Blvd., not far from the crash site. He told police he couldn't find a cell phone to make the call from the crash site.

He was taken by medical helicopter to IU Health Methodist Hospital in Indianapolis for treatment.
