Judge Allows Ambulance Run Document In As Evidence

(BEDFORD) - Testimony continued Thursday in Lawrence Superior Court I in the trial of 32-year-old Kyle Hutton. Most of the testimony given was over a paramedic run sheet and if that run sheet would be entered into evidence.

IU Health Hospital Paramedic Mike Bierbaum testified he was "not 100 percent sure" who told him Kyle was driving the CJ7 Jeep the night of July 28, 2012 when it crashed on Bailey Scales Road.

The accident killed Hutton's wife 30-year-old Morgan Hutton, 33-year-old Dasan Spires and 38-year-old Laura Duncan.

Bierbaum testified he was sure that the information on the run sheet was accurate because it was filled out before his shifted ended the day of the accident. Brierbaum, who has been on more than 1,000 run in his career as a paramedic, can't recall every run from memory.

At issue was if the run sheet could be entered as evidence and presented before the jury.

After several hours of testimony, with the jury sequestered in another room, Judge Robbins determined the run sheet could be presented to the jury.

Defense Attorney Samuel Shapiro protested that ruling says the document violates Hutton's state and federal constitutional rights because Bierbaum told Bloomington Detective Major Rob Herr on October 3rd and again on Oct. 12, 2012, he was not 100 percent sure who was driving the Jeep.

According to Deputy Prosecutor Jody Donaldson, Hutton's blood-alcohol content was more than three times the legal limit the night of the deadly crash. Hutton is charged with three counts of causing death while operating a vehicle with a blood alcohol level of .15 or greater. Testimony will resume Friday morning.
