(ORANGE CO.) - No charges are expected to be filed in connection with the death of 23-year-old Jacob Grimes of Paoli, who died as the result of a gunshot wound during a home invasion early Tuesday morning in Orange County.

Orange County Prosecutor Kelly Minton has reviewed state law pertaining to the use of deadly force to protect life or property and determined no charges will be filed.

Indiana State Police say 61-year-old Terah Frost shot Grimes, who had a knife and was fighting with Frost's brother, 59-year-old Barry Frost.

The homeowners, Barry Frost and Terah Frost, heard someone break into the home just after 1 a.m. Tuesday and rushed to their mother's room to check on her and make sure she was safe.

The two men then went downstairs to investigate and found the door busted but could not find anyone in the home.

The two then went looking for tools to repair the door. That is when Barry opened the cellar door and Grimes punched Barry and there was a physical altercation.

Terah, who was in the other room, heard the fight and came to assist. That is when he found his brother fighting with a man in a hooded sweatshirt with a bandana over his face and yielding a knife.

Terah retrieved a handgun and shot Grimes, who died at the scene.
